Thank you for visiting LocalReplay.com!  NetDimensional, LLC, a Delaware limited liability company and owner and operator of LocalReplay.com (collectively referred to herein as “LocalReplay”), is committed to protecting your privacy when you visit LocalReplay.com (the “Site”) or use the services provided by LocalReplay (the “Services”), as further outlined in this Privacy Policy (this “Policy”) and the Terms of Use Agreement. From time to time, LocalReplay may ask you for personal information about yourself and your organization through opt-in correspondence or when you register for or download the Services. For example, each person who registers on the Site is required to provide their email address, first and last names, gender, birth date, high school information, sports interest and in certain cases zip code. In addition to the required registration information, you may provide additional information about yourself or others, such as schedules, sports statistics, scores, favorite athletes, photos, videos and more.  LocalReplay gathers this information in order to serve you better, through such services as customization of Content downloadable through the Services. You agree to provide LocalReplay true, complete, current and accurate information when prompted for personal information and agree to keep this information up-to-date at all times. Please note that nowhere on the Site does LocalReplay knowingly collect contact information or financial information from children under the age of 13.  Please review this privacy policy periodically as we may update it from time to time.  

Amendment of Policy.  LocalReplay may, in its sole discretion, modify this Policy from time to time. Each modification of this Policy will be posted on the Site.  You agree to be bound to any changes to this Policy when you use the Site and Services after any such modification is posted. It is therefore important that you review this Policy regularly to ensure you are updated as to any changes.

Use of Your Information.   LocalReplay is anti-spam. While LocalReplay may offer several e-mail story notification options to you (for audio, video, photo and Content convenience), they are offered on an opt-in basis, meaning that you must indicate your desire for such services or else you will not receive them. You may opt to have LocalReplay stop sending these types of e-mail notifications at any time. LocalReplay may also, infrequently, send single e-mail messages to all Users, to communicate important news or to verify that their account is still active. If you believe that any party may have violated this Policy or the privacy of your information in any way, please contact LocalReplay immediately at: info@localreplay.com.

LocalReplay’s policy is not to provide any list of users, user addresses, user email addresses or other such user information to third parties for commercial purposes. However, from time to time LocalReplay, or LocalReplay on behalf of it’s affiliated partners, will contact you via email, direct mail, fax or other means to make you aware of promotional offerings, prize giveaways, service upgrades, partner/alliance announcements and other generally important information. Additionally, LocalReplay may occasionally reference your name or your company name in customer lists or press releases issued by LocalReplay regarding the licensing of the software or Content and/or usage of the Site and Services.

LocalReplay may use your demographic information to perform business analyses or to tailor the Site and communications to your interests. LocalReplay may share anonymous, aggregated demographic information with advertisers and other third parties so that they can tailor their advertisements and communications to the appropriate audience. Any time that LocalReplay is allowed under this privacy policy to share your contact information or financial information, LocalReplay may also share your demographic information along with it.

In addition, LocalReplay may disclose information about you if LocalReplay determines that disclosure is necessary to investigate a complaint regarding your use of the Site and/or the Services, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) LocalReplay’s rights or property, or the rights or property of visitors to or users of the Site, including LocalReplay’s users. You acknowledge and agree that LocalReplay retains rights to all transmittals or communications by you with LocalReplay or other users through the Services or any other service offered on or through the Site, and may also disclose such data and information if required to do so by law or if LocalReplay determines that such maintenance or disclosure is reasonably necessary to comply with legal process, enforce this Agreement, respond to legal claims that such information violates the rights of others, or to protect the rights, property or personal safety of LocalReplay, its employees, agents, licensors, users of or visitors to the Site or any of the Services, as well as the public.

Use of Tracking Data.  A “cookie” is a small file that LocalReplay saves on your computer’s hard drive that contains non-personal information. These cookies help to give you faster access to pages you have already visited. They also allow you to personalize your pages, and optimize your experience at the Site. LocalReplay also uses cookies to determine the volume and other characteristics of visitors to the Site. This information helps LocalReplay figure out which features are highly successful and which features might need improvement. You can disable cookies on your computer by making the appropriate selection in the preferences or options menus in your browser. Most browsers accept cookies automatically, but allow you to disable them. Disabling cookies may prevent you from properly using the Services or accessing the Site. 

“Session IDs” allow LocalReplay to identify a particular user across multiple web page requests. This Session ID is maintained within your cookie file, where possible. If cookies are not enabled, or if the user’s internet browser program does not support cookies, then LocalReplay will place the Session ID in the requested web page. This allows the end user to avoid having to continually re-enter Certain information such as account name and password for every web page request. This Session ID expires whenever the user closes their internet browser.

Many of the LocalReplay web pages also contain special electronic images (called a “single-pixel gif” or “gifs”) that allow LocalReplay to gather only non-personally identifiable traffic statistics and other aggregate information about visitors to the Site. LocalReplay (through itself or third parties) uses this technology to collect and accumulate anonymous data that helps LocalReplay understand and analyze the experience of people visiting the Site and, along with other information you provide, customize your future visits and improve the Site.   

Each time you visit the Site, LocalReplay automatically collects your IP address and the web page from which you came. In order to administer and optimize the Site for you and to diagnose problems with the Site, LocalReplay uses your IP address to help identify you and to gather broad demographic information about you.

The Services may include the use of ad banner partners for the serving and/or targeting of ads, promotions, and other marketing messages. These ads may be provided, in some cases, by a third party ad service provider. The ad service provider may place or utilize their own unique cookie on your browser, and may use non-personally identifiable information about your visit to the Site, such as the number of times you have viewed the ad. LocalReplay is not responsible for the collection of these cookies and is not responsible for the actions of the ad service providers. LocalReplay does not sponsor, endorse or guarantee any products or services advertised by third parties on the Site.

In order to provide more relevant advertising and monitor user bandwidth usage (as governed by the LocalReplay Terms of Use Agreement (http://termsofuse.localreplay.com), LocalReplay may gather data from logs that identify where and how frequently user images being hosted by LocalReplay are being displayed on third party sites.

Information on Other Sites.  LocalReplay may place links to other web sites operated by other parties. Some of these other web sites contain LocalReplay’s brand names and trademarks and other intellectual property that LocalReplay owns. When you click on these links and visit these other web sites, you need to be aware that LocalReplay does not control these other web sites or these other web sites’ business practices, and that this privacy policy does not apply to these other web sites. Consequently, the operators of these other web sites may collect different kinds of information about you, and may use and disclose that information in different ways than LocalReplay would if it were collected on the Site. LocalReplay encourages you to review their privacy policies and remind you that LocalReplay will not be responsible for their actions.

Security.  LocalReplay is the sole owner of the information collected through the Site and Services registration. You recognize that Internet connections, e-commerce and downloading media, Content and files from the Internet are never completely private and secure. Every effort has been made to ensure your security and privacy by LocalReplay. You also understand that when you send a message, information or credit card data through the Site, although LocalReplay’s transactions are encrypted, there may be the possibility of another person reading or intercepting your data. LocalReplay recognizes that personal and company information that may be entered may be of a confidential or sensitive nature. LocalReplay’s applications have been designed to be resistant to the inappropriate access or disclosure of such information to other registered and unregistered users.
